Terms of Service

1. Introduction

Welcome to InstaCaptain, operated by Velox APP LTD, a company registered in the United Kingdom ("we", "us", "the Platform"). By using our website and mobile application, you agree to be bound by these Terms of Service. Please read them carefully.

2. Description of Service

InstaCaptain is a digital recruitment platform that connects food and grocery delivery companies ("Employers") with delivery riders and drivers ("Job Seekers") in Saudi Arabia. We provide:

  • Job advertisement posting for food and grocery delivery Employers
  • Job browsing for delivery riders and drivers seeking employment
  • Interest expression and direct WhatsApp communication between Employers and Job Seekers
  • Push notifications for new delivery job opportunities

InstaCaptain acts solely as an intermediary platform. We do not employ riders, manage deliveries, or guarantee any employment outcomes.

3. Eligibility & User Accounts

To use our services, you must:

  • Be at least 18 years of age
  • Provide accurate, truthful, and current information during registration
  • Keep your account credentials confidential
  • Notify us immediately of any unauthorized use of your account
  • Not create an account on behalf of another person without their consent

The Platform is strictly intended for adults. We do not knowingly permit users under 18 to register or use the Service.

4. Job Seeker Obligations

As a Job Seeker (delivery rider or driver), you agree to:

  • Provide accurate information about your vehicle type, experience, and availability
  • Only express interest in jobs you genuinely intend to pursue
  • Comply with all applicable Saudi Arabia labour and traffic laws
  • Hold any licences or permits required to operate as a delivery rider in your city
  • Not misrepresent your qualifications, experience, or documents to Employers

5. Employer Obligations & Payment

As an Employer, you agree to:

  • Post only genuine food or grocery delivery job vacancies
  • Provide accurate job descriptions, including compensation and working conditions
  • Comply with Saudi Arabia labour law regarding employment of riders
  • Not contact Job Seekers for purposes unrelated to the posted job

Employers pay fees to post job advertisements. Payments are processed through Paddle (our authorised payment gateway and Merchant of Record). By completing a purchase, you agree to the prices on our pricing page, Paddle's billing terms, and applicable VAT (15%).

6. Acceptable Use

You agree not to:

  • Post false, misleading, or fraudulent information
  • Post job advertisements for roles other than food or grocery delivery
  • Use the Platform for unlawful, harassing, or abusive purposes
  • Attempt unauthorized access to the Platform or its systems
  • Send spam or unsolicited commercial messages to other users
  • Scrape, copy, or redistribute Platform data without written consent
  • Impersonate any person or organisation

7. Child Safety & Prohibited Content

InstaCaptain has a zero-tolerance policy toward any content or conduct that exploits, harms, or endangers minors. The following are strictly prohibited on the Platform:

  • Any content that sexually exploits or abuses minors (CSAE/CSAM)
  • Any attempt to groom, solicit, or exploit children
  • Any job listings targeting or involving individuals under 18

Any violation will result in immediate account termination and will be reported to the relevant authorities, including the National Center for Missing & Exploited Children (NCMEC) where applicable.

8. Account Deletion

You may delete your account at any time by:

  • Using the "Delete Account" option in the app's Profile settings, or
  • Sending a deletion request to velox.app.dev@gmail.com

Upon deletion, all your personal data (name, phone number, city, nationality, vehicle type, experience, and device token) will be permanently and irreversibly removed from our servers within 30 days. Deletion cannot be undone.

9. Disclaimer of Liability

InstaCaptain acts solely as an intermediary connecting Employers and Job Seekers. We:

  • Do not guarantee employment, hiring, or any specific working conditions
  • Are not a party to any employment agreement between Employers and Job Seekers
  • Do not independently verify the accuracy of all posted advertisements or rider profiles
  • Are not liable for any direct, indirect, or consequential losses arising from interactions between users
  • Are not responsible for disputes between Employers and Job Seekers regarding pay, working conditions, or contract terms

10. Intellectual Property

All content, trademarks, and designs on the Platform are the property of InstaCaptain / Velox APP LTD. They may not be copied, distributed, or used without prior written permission.

11. Termination by Us

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or the Platform. You will be notified via your registered phone number where possible.

12. Changes to Terms

We reserve the right to modify these Terms at any time. You will be notified of material changes via the app or email. Your continued use of the Platform after the effective date of any modification constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising from use of the Platform shall be subject to the jurisdiction of the competent Saudi courts, without prejudice to any mandatory consumer protection rights under UK law applicable to Velox APP LTD.
